Definitions  

Golden State Software Systems, Inc., 270 N. El Camino Real, Suite F-17, Encinitas, CA 92024-2874 shall hereinafter be referred to as "GS³".  

The Source Highlighter^®(containing programs and other software objects), the download files(shsavf.savf and shsavf.zip), the installation instructions, and this license agreement in whole or in part shall hereinafter be referred to as "The Product".  

Preamble  

The Product is distributed as a free service to visitors of GS³'s web site for their own personal use only. The Product is licensed to you subject to the terms and conditions of this agreement by GS³ which owns the title to The Product and to all intellectual property rights therein. All rights in The Product are reserved to GS³ except those rights expressly granted to you in this agreement. By downloading, installing, or using The Product, you agree to be bound by the terms and conditions of this Agreement.  
 

1. Disclaimer of Warranty  

A. The Product is provided "AS IS" without warranty of any kind. GS³ assumes no responsibility for defects in The Product or that any defects in The Product will be corrected. You assume the entire risk as to the use of The Product. In no event shall GS³'s total liability to you, for any reason or circumstance, exceed the amount paid by you for The Product.  
 

2. Limited License  

GS³ grants you a limited, nonexclusive, nontransferable license to use The Product. If you fail to comply with any provision of this agreement, this agreement and your rights hereunder shall immediately terminate at which time you agree to destroy all copies of The Product that are in your possession or under your control. You agree not to install The Product at your place of employment without first obtaining the proper approval by your employer who may not grant their approval without first reading this agreement and agreeing to be bound by all of the terms and conditions contained herein. You agree that you will use The Product exclusively as a tool to facilitate your programming endeavors and that you will not sell, rent, lease, publish, license, distribute, or export outside the USA The Product in whole or in part or incorporate The Product in any way in any software that you create for any commercial purposes. You further agree not to modify The Product in any way including any attempt to remove GS³'s copyright, or trademark notices from any portion of The Product. All rights not expressly granted herein are retained by GS³.  
 

3. General Provisions  

Nothing in this Agreement constitutes a waiver of GS³'s rights under U.S. copyright laws or any other federal, state, local, or foreign law. This Agreement shall be governed under California law.
